Article 20 provides that Member States shall require that credit agreements and any modifications of such agreements are drawn up on paper or another durable medium and that all the contracting parties are provided with a copy of the credit agreement.

However, Member States may introduce or maintain national rules regarding the validity of the conclusion of credit agreements which are in conformity with Union law.

Question 12 – Should Ireland introduce any further such national rules on the validity of the conclusion of credit agreements?

No. Ireland is already subject to stringent rules on the conclusion of credit agreements e.g., as per the Consumer Credit Act 1995.
No. We have sufficient rules in place in the CUA, the Consumer Protection Code and the Consumer Credit Act.
Overall, we expect the Irish Government to aim for harmonization of rules with other Member States as much as possible, to avoid uncertainty for providers that offer their services cross-border....
