3.2 Article 2(6) of CCD2
In transposing the Directive, Member States may provide that credit agreements concluded between organisations and members that fulfil specific criteria need only apply a limited number of provisions of the CCD2, inter alia exempting creditors from the obligation to perform a creditworthiness assessment. The organisation must fulfil the conditions outlined in Article 2(6) of CCD2. This exemption is similar to that provided for under CCD1 and SI 281 of 2010. According to the 2022 Annual Report of the Registrar of Friendly Societies, two credit union co-operative societies have exemptions to parts 2-7 of SI 281 of 2010:
- Ardlea Co-operative Limited
- Finglas West Credit Union Co-operative Limited
Question 2 - Are there any other specific organisations that Ireland should apply the discretion provided by Article 2(6)?
